Regulation 1. Identity and address of the person responsible
For the purposes of this Privacy Notice, MEDIGIENE, S.A. DE C.V. (hereinafter "the Responsible"), with a home in Calle Jaime Balmes 11, Interior 10 Torre A Piso 1, Colonia Polanco I Sección, Alcaldía Miguel Hidalgo, C.P. 11510, Mexico City, is responsible for the processing of personal data collected through the website vitalred.com.mx as well as by other physical, electronic or remote means capable of customer care, sales and order tracking.

Regulation 2. Personal data to be collected
The Responsible may, directly or indirectly, collect personal data for the identification, contact, delivery, billing and transaction necessary for the operation of the site and the care of orders, such as name, e-mail, telephone number, place of dispatch, tax address, RFC and other information necessary to process purchases or issue tax vouchers where appropriate.
The Responsible may also collect navigation and site use data, such as IP address, browser type, operating system, visited pages, dates and times of access, cookies and similar technologies, for operational, statistical, security and improvement of user experience.
In principle, the Responsible does not request sensitive personal data; however, if, by the nature of any interaction or procedure, additional processing of data in that category is required, the appropriate consent shall be requested in the terms specified by the applicable legislation.
Regulation 3. Primary purposes of treatment
The personal data collected shall be processed for the purposes necessary for the existence, maintenance and compliance of the legal relationship between the holder and the Responsible, including, in a more non-limited manner, the following: to identify the customer, to register and process orders, to manage payments, to coordinate shipments, to issue invoices, to address doubts, claims or requests related to the products placed on the market, and to follow up on returns, cancellations or refunds.
They may also be used for the purposes of validation of operations, fraud prevention, security of transactions and compliance with legal, fiscal and administrative obligations arising from the business activity of the Responsible.
Regulation 4. Secondary purposes
In addition, and provided that the holder does not express its opposition, personal data may be used for secondary purposes compatible with the commercial relationship, such as the sending of promotional information, commercial notices, news, product recommendations, loyalty campaigns, satisfaction surveys and internal analysis on consumption habits and site performance.
If the holder does not wish to have his data processed for these secondary purposes, he may at any time express it by means of communication addressed to the e-mail. ventas@vitalred.com.mx without affecting the provision of services or the care of existing orders.
Regulation 5. Consent of the holder
The holder consents to the processing of his personal data when he provides them voluntarily through the site, contact forms, purchase processes, care channels or any other means enabled by the Responsible, and when he continues to use the site once this Privacy Notice is made available to him.
Where the applicable rules so require, the Responsible shall implement express acceptance mechanisms for certain specific purposes or specific treatments.
Regulation 6. Transfer of personal data
The Responsible may transfer personal data to third parties only to the extent that this is necessary for the fulfilment of the purposes provided for in this Notice, including technology service providers, electronic commerce platforms, payment processors or aggregators, messaging and parcel services, accounting or tax advisers and competent authorities where there is a legal requirement or valid mandate.
In all cases, such transfers shall be made by ensuring that third-party recipients assume confidentiality and security obligations in accordance with the nature of the information treated and the applicable legislation.
Regulation 7. Security measures
The Responsible takes reasonable administrative, technical and physical measures to protect personal data from damage, loss, alteration, destruction, use, access or treatment, taking into account the nature of the data and the risks associated with its processing.
Notwithstanding the above, the holder recognizes that no electronic system or Internet transmission can guarantee absolute security, so the Responsible cannot ensure that violations do not occur beyond its reasonable control.
Eighth clause. Use of cookies and similar technologies
The site may use cookies, electronic labels, web analytics or other similar technologies to facilitate navigation, recognize preferences, maintain operational functions of the site, analyse usage patterns, measure performance and strengthen platform security.
The user will be able to modify your browser settings to refuse or limit the use of cookies; however, some site features may be affected by such settings.
Clause 9. ARCO rights and revocation of consent
The holder, or his duly accredited legal representative, may at any time exercise his rights of Access, Rectification, Cancellation and Opposition to personal data in the possession of the Responsible, and revoke the consent granted for its processing, to the extent that this is legally appropriate.
For the exercise of these rights, the holder shall submit an application to the e-mail. ventas@vitalred.com.mx indicating at least its full name, address or any other means of receiving notifications, clear and precise description of the personal data for which it seeks to exercise any of the ARCO rights, the right it wishes to exercise and, where appropriate, the documents that demonstrate its identity or legal representation, as well as any other element that facilitates the location of the relevant personal data.
In the case of requests for rectification, the holder shall also indicate the amendments to be made and provide the documentation supporting his request.
The person responsible shall inform the holder of the decision taken within a maximum of 20 working days from the date on which the application is received, so that, where appropriate, the request is made effective within 15 working days of the date on which the reply is communicated.
The time limits referred to above may be extended only once for an equal period, provided that the circumstances of the case so warrant.
Where the person responsible denies in whole or in part the exercise of the ARCO rights, he shall inform the holder of the reason for his decision by the same means in which the application was made or by the means indicated for receiving notifications, within the legally applicable time limits.
Regulation 10. Limitation of use or disclosure
The holder may at any time request the limitation of the use or disclosure of his personal data, particularly for promotional or advertising purposes, by means of communication sent to the mailventas@vitalred.com.mx. El Responsable implementará, en la medida de lo posible, mecanismos internos para registrar y respetar dichas preferencias.
Cláusula Décima Primera. Conservación de la información
Los datos personales serán conservados únicamente durante el tiempo que resulte necesario para cumplir con las finalidades descritas en este Aviso, así como para atender obligaciones legales, contractuales, fiscales, de seguridad o de resolución de controversias que pudieran derivarse de la relación con el titular.
Una vez concluido dicho periodo, el Responsable podrá proceder a su supresión, bloqueo o anonimización, según corresponda conforme a la legislación y a sus políticas internas.
Cláusula Décima Segunda. Cambios al Aviso de Privacidad
El Responsable se reserva el derecho de modificar, actualizar o ampliar en cualquier momento el presente Aviso de Privacidad para reflejar cambios legales, regulatorios, operativos o de negocio. Cualquier modificación será publicada en el sitio web vitalred.com.mx, indicando la fecha de última actualización, por lo que se recomienda al titular revisar periódicamente este documento.
Cláusula Décima Tercera. Aceptación
La entrega de datos personales por cualquier medio habilitado por el Responsable, así como el uso continuo del sitio o la realización de compras a través del mismo, implica que el titular ha leído, entendido y aceptado el contenido del presente Aviso de Privacidad, en lo que resulte aplicable.
