Regulation 1. Supplier's identity
These Terms and Conditions regulate access, navigation, use and products through the website vitalred.com.mx , operated by MEDIGIENE, S.A. DE C.V., with home in Calle Jaime Balmes 11, Interior 10 Torre A Piso 1, Colonia Polanco I Sección, Alcaldía Miguel Hidalgo, C.P. 11510, Mexico City, and with email contact ventas@vitalred.com.mx and telephone + 52 1 55 1553 4245 (hereinafter "the Supplier").
Any person who accesses or acquires products through the site agrees to submit to these Terms and Conditions, as well as other policies published on the site itself.
Regulation 2. Object of the site
The site aims to promote, offer, market and online sale of products related to maternity, lactation, baby care, hygiene, monitoring and health support at home, including, in a more non-limited way, milk extractors, nasal aspirators, baby monitors, bath cushions, kangaroos, ecological diapers, baby nests, nebulizers, thermometers, nipples, breast milk storage bags and postpartum fences.
The commercial information, descriptions, images, characteristics, suggested uses and prices of the products published on the site are informative and seek to facilitate the user's purchase decision.
Regulation 3. Capacity to hire and use allowed
They may only make use of the site and conduct operations of persons who have the legal capacity to hire under Mexican law. The user is required to use the site in a lawful manner, without performing acts that affect the rights of the Supplier, other users or third parties, or using the content of the site for fraudulent, misleading or unauthorized purposes.
It is prohibited, inter alia, to copy contents of the site without authorization, misuse product marks, images or chips, interfere with the operation of the portal or enter malicious code.
Regulation 4. Product characteristics
The products offered on the site are mainly personal care, maternity, breastfeeding, hygiene and support for health and well-being at home. Some products can be considered care supplements, while others work as support devices for domestic monitoring or treatment, such as nebulizers, thermometers and baby monitors.
The user recognizes that the description, instructions, warnings, recommended age, form of use and, where appropriate, the manufacturer's instructions must be carefully read before any product is used. The purchase of a product does not replace medical, paediatric or professional valuation where necessary.
Regulation 5. Prices, currency and taxes
All the prices of the site must be shown in national currency, clearly and visibly before the purchase is completed, indicating whether they include the Value Added Tax or whether it will be added at the end of the operation. For this trade, the catalog prices are expressed in Mexican pesos and published with their commercial reference visible to the user before payment.
The supplier may update prices, promotions, availability and commercial conditions at any time; however, once the purchase has been confirmed and the payment has been received, the price applicable to that particular operation shall be respected, unless manifest or clear system error.
Regulation 6. Availability of products
All products offered on the site are subject to existence and availability when processing the order. In the event that a product is not available after an order has been generated, the Supplier may inform the user of this circumstance to offer an alternative, reprogram the delivery or manage the corresponding refund.
Regulation 7. Purchase procedure
To purchase products on the site, the user must select the desired items, add them to the relevant cart or purchase module, provide the requested information for identification, delivery and billing, review the summary of your order and make payment by the enabled means. After completion of the process, the user must receive an electronic confirmation in the detail of the operation carried out.
The purchase order shall be subject to validation, including verification of payment and availability of the product. The Provider may refrain from processing orders when it detects inconsistencies in the information provided, evidence of fraud, unauthorized charges or prior user breaches.
Eighth clause. Forms of payment
The site may accept the means of payment that are expressly indicated in the purchase process, including debit cards, credit cards and other mechanisms enabled by the Provider or its authorized payment gateway, as appropriate. The user recognizes that the payment processing may be carried out by specialized third parties, who will apply their own operational terms and security measures.
Clause 9. Delivery of products
The Provider shall deliver according to the coverage, estimated time and logistical conditions informed on the site or during the purchase process. Delivery times are estimated and may be affected by causes outside the Supplier, including high demand, product availability, parcel coverage, fortuitous or force majeure events.
The delivery shall be understood to have been made when the product is made available to the user at the address indicated in the order, through the usual confirmation mechanisms of the carrier undertaking or the supplier itself.
Regulation 10. Review of the order at the time of receipt
The user shall, as far as possible, review the general status of the package upon receipt. If you notice visible damage, lack of parts, error in the assortment or any apparent anomaly, you must report it in a timely manner in accordance with the Return, Cancellations and Repayments Policy published on the site.
Clause Tenth First. Responsible use of products
Given the nature of the catalogue, which includes products intended for breastfeeding, newborn care, maternity, monitoring and support for respiratory health or domestic welfare, the user will be responsible for verifying that the product is suitable for his or her needs and for using it in accordance with the manufacturer's instructions. The supplier shall not be liable for damage arising from a use other than that recommended, negligent use, incorrect installation, inadequate handling, failure to provide warnings or lack of supervision where reasonably necessary.
Clause Tenth Second. Electronic confirmation of the operation
Once the purchase is made, the user will receive an electronic confirmation with the essential information of the transaction, including the products purchased, the amount paid, taxes applicable if applicable and the general data of the order, as recommended by good electronic commerce practices.
Third Tenth Regulation. Intellectual property
Los contenidos del sitio, incluyendo su diseño, textos, logotipos, fotografías, gráficos, fichas, software, estructura y demás elementos, son propiedad del Proveedor o de sus respectivos titulares y se encuentran protegidos por la legislación aplicable en materia de propiedad intelectual. Queda prohibida su reproducción, distribución, modificación, explotación o uso no autorizado por cualquier medio.
Cláusula Décima Cuarta. Protección de datos personales
El tratamiento de los datos personales del usuario se sujetará al Aviso de Privacidad publicado en el sitio, el cual forma parte complementaria del marco legal.
Cláusula Décima Quinta. Limitación de responsabilidad
El Proveedor procurará que la información del sitio sea clara, suficiente y actualizada; sin embargo, no garantiza que el portal opere de forma ininterrumpida o libre de errores técnicos en todo momento. En la máxima medida permitida por la ley, la responsabilidad del Proveedor frente al usuario se limitará al monto efectivamente pagado por el producto que haya dado origen a la reclamación correspondiente, sin perjuicio de los derechos que asistan al consumidor conforme a la legislación aplicable.
Cláusula Décima Sexta. Suspensión, restricción o cancelación de acceso
El Proveedor podrá restringir, suspender o cancelar el acceso al sitio, así como rechazar operaciones, cuando detecte fraude, uso indebido del portal, incumplimiento a estos Términos o cualquier conducta que ponga en riesgo la operación del comercio o a otros usuarios.
Cláusula Décima Séptima. Modificaciones
El Proveedor podrá modificar en cualquier momento el contenido de estos Términos y Condiciones para adecuarlos a cambios operativos, legales, comerciales o tecnológicos. Las actualizaciones deberán publicarse en el sitio con su fecha de última modificación y surtirán efectos desde su publicación, salvo que se indique expresamente una fecha distinta.
Cláusula Décima Octava. Legislación aplicable y jurisdicción
Estos Términos y Condiciones se regirán conforme a las leyes aplicables de los Estados Unidos Mexicanos. Para la interpretación, cumplimiento y resolución de cualquier controversia relacionada con el uso del sitio o con las operaciones celebradas a través del mismo, las partes se someten a la jurisdicción de los tribunales competentes de la Ciudad de México, salvo disposición legal imperativa en favor del consumidor.
